Yesterday (16.08.2024), Aruna Laksiri Unawatuna AAL reqested from  President Ranil Wickramasinghe, Secretary of Ministry of Justice  M. N. Ranasinghe, Attorney General Parinda Ranasinghe PC to establish a “Special Appellate Constitutional Council” to seek relief from penalties, arrest, holding in custody, detainment or deprivation of other personal liberties of a person, imposition of fines or court fees by the Supreme Court as a court of first instance.

He has pointed out in his request that the Supreme Court has jurisdiction to impose penalties, arrest, hold in custody, detain or deprive other personal liberties of a person, impose fines or court fees and under the existing laws, the number of cases initiated for the first time in the Supreme Court as a court of first instance has increased.

It has been pointed out that the
law has not provided an opportunity to appeal against penalties, arrest, holding in custody, detention or other deprivation of personal liberty of a person, fines or court fees imposed for the first time in a case initiated in the Supreme Court, and due to this, some persons are tempted to seek foreign judicial mechanisms and it is an adverse situation for the sovereignty, independence and reputation of Sri Lanka and for the  people’s sovereignty as well.

In consideration of the above facts, International Conventions and existing laws in this country, Aruna Laksiri Unawatuna AAL reqested  to the President, Secretary of Ministry of Justice and Attorney General to establish a “Special Appellate Constitutional Council” to seek relief from penalties, arrest, holding in custody, detention or other deprivation of personal liberty of a person, fines or court fees imposed in a case that initiated in the Supreme Court for the first time from 02 years ago and also to take immediate steps to draft the laws and present them to the Parliament.
